December 20—Yesterday, a slim majority of liberal Colorado Supreme Court justices issued an unprecedented decision to remove former President Trump from their state’s 2024 ballot. The Court is attempting to claim the former President is ineligible under the 14th Amendment insurrection clause, although Donald Trump has never been convicted of insurrection by any jury.
The Republican Party of New Mexico chairman and former U.S. Representative for New Mexico’s Second Congressional District, Steve Pearce, issued the following statement:
“The Colorado Supreme Court’s ruling to keep former President Trump off the ballot should disturb every American regardless of party affiliation.
Attempting to disqualify the leading Republican Presidential candidate from receiving votes while ignoring adequate due process is a disgraceful assault on the right to a free and fair election.
We cannot allow radical progressives to deny citizens their choice and right to a fair democratic process as they do in Socialist countries. The will of the American people, not a rogue group of judges, should decide who the next President will be.
The U.S. Supreme Court should swiftly strike down this order.
If Democratic politicians, especially in New Mexico, will not condemn this egregious ruling, they should never claim they stand for ‘democracy’ or ‘voting rights.’
The Republican Party of New Mexico will fight to protect every citizen’s right to vote from any attempted assaults within our state.”
Mr. Trump must be tired of losing in court. MAGA extremists like Mr. Pearce would be tired of all the losses, too, but they are so gullible they believe Trump is being picked on by bad actors.
As ever, the Constitution and facts are on the other side. The 14th Amendment bars from office anyone who participated in, aided or abetted insurrection, all of which Trump did, and says nothing about due process or conviction of a particular crime.
At least this case flushed Pearce into the open. He had not used the word “Trump” in this space since the day after the Mar a Lago search when he blamed the FBI for being bad actors picking on poor Donald. (Photos of the evidence shut him up for sixteen months.)
NM Republicans need to prepare for big losses coming soon in the Supreme Court, because the law isn’t going to change and damning facts keep piling up. The GOP base better prepare because Mr. Pearce and other party “leaders” don’t have the guts or integrity to admit there’s a problem. If they did, they would have dumped Trump years ago.
The 14th Amendment to the US Constitution didn’t define insurrection or mention due process because those that wrote it expected us to know insurrection when we see it in our mist.
It’s obvious to all but the willfully blind that Trump and many in GOP have participated in an insurrection.
Just to clarify with some of the people on here, the 14th Amendment Section 3 actually does not disqualify Trump from running for President again. The 14th Amendment Section 3 states that “No person shall be a Senator or Representative in Congress, or elector of President or Vice President, or any office, civil or military under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.” Now, I just want to clarify that the first part of the 14th Amendment Section 3 says “No person shall be a Senator or Representative in Congress, or elector of President or Vice President”. I want to mainly talk about the “elector of President or Vice President” part of that sentence that I just read to you. The Left and all these states, including Colorado and Maine, who are actually trying to remove Trump from running for President again and from the ballot in 2024, seem to think that “elector of President or Vice President” means that they can disqualify a President, or former President if you want to call Trump that, from running for office again. I just want to make clear that that is not what it means. The two definitions of elector are that they are a qualified voter in a election and/or their members of the Electoral College of the United States. It does not mean the actual President of the United States and it doesn’t mean the actual office of the President of the United States or Vice President themselves. They, and I mean the Left and Colorado and Maine, seem to be misinterpreting the Constitution, in particular the 14th Amendment Section 3 in that regard and that is dangerous. Also, it says “or executive or judicial officer of any State” which also does not mean the President of the United States or Vice President of the United States either.
Also, the Left and Colorado and Maine and all these other states who are trying to remove Trump from running again, believe that he committed an insurrection on January 6 and believe that the 14th Amendment Section 3, just automatically means that he’s disqualified from running again simply because the 14th Amendment Section 3 says what it says. Again, the 14th Amendment Section 3 actually doesn’t mean the actual President or Vice President, or in this case, former President if you want to label Trump as that, when it comes to the 14th Amendment Section 3, or the Insurrection Clause as it is called. I just want to make that perfectly clear for you. And it certainly doesn’t apply to Senators or Representatives in Congress who are Republicans or just common sense minded people either, nor military officers who are common sense minded. But in Trump’s case, because he’s the President, or former President if you wish to call him that, the 14th Amendment Section 3 actually doesn’t apply to him and it actually doesn’t disqualify him from running again. And another thing, Trump did not commit an insurrection on January 6. If you actually watch the actual 40,000+ hours of footage and audio from January 6, number one, he wasn’t even there at the Capitol building when this supposed insurrection took place and number two, he said, on video and on audio, in his speech from January 6, which you can find on the Wall Street Journal’s website where they posted the speech and on other sites where the speech was uploaded, to peacefully and patriotically march to the Capitol building and to peacefully and patriotically protest the results of the election at the Capitol building, which is not only freedom of speech, but is freedom of assembly. The fact that the Left and the January 6, which was not bipartisan, it was a Democratic Party-led partisan committee simply created to try to prevent Trump from running again because he’s against their radical leftist agenda including abortion up to and including birth and after birth policies, and forcing women to compete with biological males in women’s sports, therefore endangering women’s sports, etc, try to silence, censor, or worse, they threw in prison the protesters who were peacefully and patriotically marching to the Capitol building to peacefully and patriotically protest the results of the election, is not only a violation of freedom of speech, but is also a violation of freedom of assembly as well. And no, the January 6 Capitol “riot” was not a riot either. If it had been a riot, then that means that the Capitol building and other buildings in D.C would have been set on fire or looted or any other characteristics of what you see in riots(like the BLM riots of 2020). But it was not a riot on January 6. It was a protest, or a rally. That is what it was and it was clearly shown on actual footage and audio. And the protesters on January 6 did not storm the Capitol building. They were invited in which is clearly shown on actual footage. And Ashili Babbit, who was killed by a Capitol police officer and the only person killed on January 6, was not armed. And the Capitol police officer who shot her, who also claimed that he didn’t know he shot her, had a history of reckless behavior, so in other words, he did know that he shot an innocent person like Ashili Babbit and didn’t care. And the several Capitol police officers who supposedly died on January 6, actually died in the days and weeks after January 6. One died from a stroke, two committed suicide, one died from a heart attack, all in the days and weeks after January 6, and actual footage of January 6 clearly shows that none of them died on January 6. And also, Trump has never been charged with insurrection nor has he been convicted of it. So in other words, the Left and Colorado and Maine and other states who are actually trying to remove Trump from the ballot, are not following the Constitution, but are misinterpreting and violating the Constitution, in particular the 14th Amendment Section 3 because it doesn’t actually apply to the President or Vice President, or former President if you wish to call Trump that. And no, not all electors are Republican. That’s also misleading. While there are electors who are Republicans, not all of them are. There’s electors who are Democrats too. Or there maybe or very likely electors who are not members of either party too. The Left says “fake Republican electors” when regarding the 2020 election, or any election. That would imply that all electors, literally all electors, during the 2020 election in every single state or U.S territory, were Republicans and that’s not true at all. Are you suggesting that Democrats, as much as I hate them because of their extreme policies including abortion up to and including birth and after birth, were elected to a majority in both houses of Congress by Republican electors? As much as I support Republicans, that’s not true. Are you also suggesting that Biden was “elected” by popular vote by Republican electors? No. In fact, Biden won the popular vote in the most populated areas of the states, including the battleground states(like Detroit, NYC, Chicago, etc), and it also includes New Mexico, where Biden won the popular vote in the most populated areas of the state(Albuquerque, Bernaillo County as a whole, Santa Fe, etc). So no, not all electors are Republicans. That is misleading. And the 2020 election was rigged by Biden and the Democrats and there was election interference during the election too. One of the reasons is the addresses, actual addresses, that people “voted from” that no longer exists or never existed. Number two, the COVID-19 stay-at-home, mask mandates, and other restrictions that took place during the election that forced millions of Americans to stay home that garnered mail-in ballots, which have been proven fraudulent, to be sent to millions of Americans at home. Number three, the people who were voting after the polls had closed, which is usually at midnight or something. And other things, including the fact that the voting machines that mysteriously changed from Trump to Biden. And etc. The only reason why the Left is saying that the 2020 election wasn’t rigged and are saying that Trump has “lied” about the election being rigged, is because their trying to cover it up, including censoring and silencing, etc anyone who tells the truth about the 2020 election being rigged, which by the way is a violation of the First Amendment too. And they also hate Trump, and fear him too because he’s against their radical and extreme policies including abortion up to and including birth and after birth, and forcing little kids to change genders to supposedly make their lives better, and forcing women to compete with biological males who transitioned into women with gender reassignment surgery, in women’s sports, etc, and another Trump presidency scares the Left so much because he’s against their radical and extreme policies that their trying to prevent him from running for President and winning again and are trying to remove him from the ballot because they assume that the 14th Amendment Section 3 actually applies to him and think that he committed an insurrection and etc. That is why their doing this. And you wonder why people are leaving the Democratic Party and the Left around the globe in droves now. But, I will tell you what is true. 82% of Democrats don’t want Biden to run for reelection. Israel is being attacked by the terrorist group Hamas, who by the way is funded by Iran and also Iran was funded by the Biden administration to fund Hamas to attack Israel and to rape, murder innocent people in Israel, including children, and Hamas, again a terrorist group, was voted into office by the Palestinians in Gaza, who have been funded by the Democrats in Congress too. Little kids are being forced to change genders to supposedly make their lives better when in reality actual statistics show that children who transition from one gender to another are more than likely to suffer from depression and other mental health issues and are more likely to commit suicide or regret transitioning from one gender to another down the road. And the United States economy is not stronger than ever as the Biden administration would like to tell you. In fact, various polls, including polls from some left-leaning organizations such as CNN, clearly show that the vast majority of Americans are now financially worse off under Biden than they were under Trump and actual economists, including those who are left-leaning, say that the U.S is heading towards a economic recession or worse unless Biden stops with his stuff. Oh, and Biden and the Biden administration also caused the border crisis when they shutdown construction of the border wall and ended Title 42 and because of this, 82% of Americans are now concerned about the border crisis. Oh yeah, and other countries are experiencing border crisises due to wrong policies too. And also, crime is rising across the globe, including in the U.S, in particular in liberal cities. And the majority of Americans are concerned about the rising crime in the United States too. I can go on, but I don’t have all day.

Ok, just wanted to make that perfectly clear to Mr. JH Cole who seems to be misinterpreting the Constitution and misinforming people. Maybe next time that Mr. Cole wants to make a false claim like that, maybe he should actually read the 14th Amendment Section 3 again, and this time more throrougly, including the”No person shall be a Senator or Representative in Congress, or elector of President or Vice President” part, but especially the “or elector of President or Vice President” part, or the”executive or judicial officer of any State”, which also doesn’t mean the President himself, or in Trump’s case, former President if you wish to call him that. So that tells me that Mr. JH Cole didn’t pay attention in U.S history class when he learned about the Constitution or something.
And no, the Republican Party in New Mexico, or any U.S state and any U.S territories, are not shrinking. People are leaving the Democratic Party in the United States as a whole in droves and people are leaving blue liberal states and cities as well. You want to know why that is? Because the policies of today’s Democratic Party, like their abortion up to and including birth and after birth policies, their policies of forcing little children to change genders by having gender reassignment surgery to supposedly make their lives better, their policies against Israel including funding Iran and Hamas in order to attack Israel and rape and murder innocent Jews in Israel including women and children, etc, are too extreme and too radical for anyone’s taste. What ever happened to, “Innocent until proven guilty?” I’m fairly certain that the framers of the Constitution of the United States of America wanted to ensure that every US citizen is entitled to due process under the law – as prescribed in the 4th and 5th Amendment in the US Bill of Rights. Under this premise, if found guilty by a jury of their peers for crimes as accused and brought to trial, (he/she) should be held accountable and be sentenced per the judicial presiding authority; correct? However, if the accused is found “not guilty,” shouldn’t the accused be released and case dismissed? Now, I ask you… has President Trump ever been convicted, or for that matter, even been indicted for “Insurrection?” The answer is undeniably, “NO”. The horrid and despicable actions of Colorado and Maine Supreme Court (and/or) Secretary of State to pre-emptively deny former President Trump to be on the primary ballot in 2024 are an egregious political partisan ploy by the democrats (again) to manipulate the 2024 election with the use of unethical and police state tactics. The people of this country/state should be the only voters in elections- not state supreme courts or state secretary of states! Loser lost and violated his oath of office. Read through the 14th Amendment, which supercedes the Bill of Rights regarding oaths and insurrections and makes no mention of due process or conviction. Facts, law and equity are against you, as usual.
So is history, because in 1860 ten slave states barred Lincoln from the ballot–Elections are always run by states–, and after the Civil War thousands of Confederate traitors were barred from office without other legal procedures.
Traitor Trump can have his jury trials in his many criminal cases.
